These Terms and Conditions ("Terms") govern your use of the Twisted Luck Sustainable Solutions website and the purchase of products or services. By accessing our website or making a purchase, you agree to these Terms.

1. General

Twisted Luck Sustainable Solutions ("we," "us," or "our") operates as a sole proprietorship. These Terms apply to all visitors, customers, and users of our website and services.

We reserve the right to update these Terms at any time. Changes will be effective immediately upon posting. Continued use of our website or services constitutes acceptance of updated Terms.

2. Products and Services

We offer the following:

Soil Amendments: Compost, worm castings, and worm castings extract

Composting Services: Residential curbside pickup and commercial waste collection

Carriage Sales: New and used carriages, custom builds, parts, and accessories

All product descriptions, images, and specifications are provided for general information and may not be fully accurate. We reserve the right to correct errors or update product information at any time.

3. Pricing and Payment

All prices are listed in U.S. dollars and are subject to change without notice. We accept payment via Wix Payments and Square.

For composting service subscriptions, billing occurs monthly. You authorize us to charge your payment method on file each billing cycle until you cancel your subscription.

Sales tax will be applied where required by law.

4. Orders and Fulfillment

By placing an order, you make an offer to purchase products or services. We reserve the right to accept or decline any order for any reason, including product availability, errors in pricing or product information, or suspected fraud.

Order confirmation does not guarantee acceptance. Your order is accepted when we ship the product or begin service delivery.

We will make reasonable efforts to fulfill orders promptly but are not liable for delays caused by circumstances beyond our control.

5. Refunds and Returns

Soil Amendments (Compost, Worm Castings, Extract):

We do not accept returns on soil amendment products. Refunds are considered on a case-by-case basis. If you believe your product is defective or does not meet quality standards, contact us within 7 days of delivery at twistedluckgardening@gmail.com.

Composting Services:

Residential composting subscriptions are month-to-month and may be canceled at any time. No refunds are provided for partial months of service.

Commercial composting contracts (6-month or 12-month agreements) are non-refundable. Early termination fees may apply as outlined in your service agreement.

Carriage Parts:

We will replace defective parts if reported within 14 days of receipt. We do not accept returns on non-defective parts.

Custom Carriages:

Custom-built carriages and custom orders are non-refundable and non-returnable. All custom orders are final once production begins.

6. Carriage Warranty

Newly built carriages purchased through us come with a 2-year manufacturer's warranty provided by Coyaltix. Warranty coverage, terms, and claims are determined solely by Coyaltix. We are not responsible for warranty claims, repairs, or disputes.

For warranty service, customers must contact Coyaltix directly. We act as a sales agent only and have no control over warranty decisions.

7. Composting Service Terms

Accepted Materials:

Residential and commercial composting customers must follow our accepted materials list. Prohibited items include bones, pet waste, plastic, treated wood, diseased plants, and non-compostable materials.

Contamination:

Occasional contamination will be sorted at no charge. Repeated contamination affecting compost quality may result in a sorting fee or termination of service.

Service Suspension or Termination:

We reserve the right to suspend or terminate composting service for non-payment, repeated contamination, or violation of service terms.

8. Limitation of Liability

To the fullest extent permitted by law, Twisted Luck Sustainable Solutions and its owner shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our products or services.

Our total liability for any claim related to products or services shall not exceed the amount you paid for the product or service in question.

Soil amendments are natural products. Results may vary based on soil conditions, application methods, and environmental factors. We make no guarantees regarding crop yield, plant health, or soil improvement outcomes.

9. Intellectual Property

All content on our website, including text, images, logos, and graphics, is the property of Twisted Luck Sustainable Solutions or its licensors and is protected by copyright and trademark laws. You may not reproduce, distribute, or use any content without our written permission.

10. Governing Law

These Terms are governed by the laws of the State of Tennessee. Any disputes arising from these Terms or your use of our website or services shall be resolved in the courts of Madison County, Tennessee.
